Montour man faces drug charges

A Montour man, discovered passed out in his vehicle earlier this week, awoke to drug charges; he’s now resting his head on a bed in a local jail cell.

According to a Marshalltown Police Department report, officers were called to a convenience store parking lot early Wednesday morning where they found Seger Tyrone Brown, 38, asleep in a car.

MPD Capt. Mike Hanken said when officers awakened Brown, they determined that he was under the influence of alcohol or some controlled substance, based on his appearance and a general lack of comprehension.

Officer attempted to get Brown to comply with a sobriety test, but he refused. Hanken said the suspect showed additional signs of impairment and he was subsequently transported to UnityPoint Health-Marshalltown for evaluation and treatment.

During a search of Brown’s vehicle, officers uncovered drug paraphernalia and empty baggies that were indicative of narcotics use.

A continuing investigation led to Brown being charged Thursday morning in Marshall County District Court with possession of a controlled substance with the intent to manufacture or deliver (7.8 grams of methamphetamine), a Class B felony; and failure to affix a drug tax stamp, a Class D felony.

A preliminary hearing for Brown is set for 1 p.m. on June 5.

He is currently being held in the Marshall County Jail on a $100,000 cash or surety bond.

Thursday

• Seger Tyrone Brown, of Montour, made an initial appearance on a possession of a controlled substance with the intent to manufacture or deliver-methamphetamine charge and a failure to affix a drug tax stamp charge. The public defender’s office is appointed as counsel. The preliminary hearing is scheduled at 1 p.m. on June 5. Bond is set at $100,000 cash or surety. Upon release, Brown will have 60 days to obtain a substance abuse evaluation and submit the results to the court.

• Jesse Lee Oelmann, of Coulter, made an initial appearance on a possession of a Schedule IV controlled substance-second offense charge and a providing a false identification information charge. Aaron Vaughn is appointed as counsel. The preliminary hearing is scheduled at 1 p.m. on June 5. Bond is set at $2,000 cash or surety. Upon release, Oelmann will have 60 days to obtain a substance abuse evaluation and submit the results to the court.

• Martin Gonzalez made an initial appearance on two probation violation charge. Merrill Swartz is appointed as counsel. The probation revocation hearing is scheduled at 1:30 p.m. on June 28. Bond is set at $10,000 cash or surety total.

• Ryan Lee Stubbs made an initial appearance on a warrant charging him with failure to file a written arraignment and two warrants charging Stubbs with failure to appear for a pre-trial conference in two different cases. Marshon Dubbert will continue as counsel for the arraignment and Aaron Vaughn will continue as counsel on the pre-trial conference cases. The arraignment hearing is rescheduled at 1 p.m. on June 1 and the pre-trial conferences are rescheduled at 9 a.m. on June 14. Bond is set at $2,000 cash or surety on the arraignment and $700 total cash on the pre-trial conferences.

• Kevin Ray Madison Jr. made an initial appearance on a driving under suspension charge and a warrant charging him with pre-trial violation. Darrell Meyer will continue as counsel for the pre-trial release case. There is a sentencing hearing is scheduled at 9:30 a.m. on June 16. Bond is set at $5,000 cash or surety. On the driving under suspension, a rocket docket pre-trial conference is scheduled at 9 a.m. on June 30 in Magistrate Court. Madison is released on his promise to appear in this matter.

• Raelynn Frances McVey made an initial appearance on a failure to appear for a contempt hearing charge. Emily Swartz is appointed as counsel. The contempt hearing is rescheduled at 9 a.m. on June 16 in Magistrate Court. McVey was released on her promise to appear.

• Emmanuel Efrain Rivera made an initial appearance on a operating while intoxicated-first offense charge, a no insurance-accident charge and a failure to maintain control charge. Christian Stickrod is appointed as counsel. The preliminary hearing is scheduled at 1 p.m. on June 5. Bond is set at $1,000 cash or surety. Upon release, Rivera will have 60 days to obtain a substance abuse evaluation and submit the results to the court.

• Joshua Eric Rieken, of Bristol, made an initial appearance on a possession of a Schedule IV controlled substance charge, a no insurance charge and a operation without registration charge. Rieken will represent self. The preliminary hearing is scheduled at 1 p.m. on June 13. Rieken is released on his promise to appear. Upon release, Rieken will have 60 days to obtain a substance abuse evaluation and submit the results to the court.

• Tressa Richelle Voss made an initial appearance on a theft charge and a possession of drug paraphernalia charge. Tyler Heeren is appointed as counsel. A pre-trial conference is scheduled at 9 a.m. on July 12 in Magistrate Court.

• Crystal Marie Lennie made an initial appearance on a theft-fifth degree charge. Jeff Hazen is appointed as counsel. The preliminary hearing is scheduled at 1 p.m. on June 13. A pre-trial conference is scheduled at 9 a.m. on June 28 in Magistrate Court.

• Cheri Nichole Mora made an initial appearance on a no proof of vaccination charge. A pre-trial conference is scheduled at 9 a.m. on July 12 in Magistrate Court.

• Cecilia Howe made an initial appearance on a warrant charging her with failure to appear for a truancy hearing. A pre-trial conference is scheduled at 9 a.m. on July 19 in Magistrate Court.

• Anthony Holcomb made an initial appearance on a striking fixtures charge and a failure to maintain control charge. Holcomb pleaded guilty to both charges. On striking fixtures the fine is $65 with a $22.75 surcharge and $60 in court costs for a total of $147.75. On the failure to maintain control the fine is $100 with a $35 surcharge and $60 in court costs for a total of $195. All payments are due within 30 days.

Accidents

• On Saturday, a pickup driven by Derek J. Hutchinson, of Tama, was eastbound on East Main Street Road when it went out of control and entered the south ditch striking a utility pole. Hutchinson didn’t report the incident until the following day, approximately 11 hours later. Hutchinson was cited for leaving the scene of an accident. Damage to the Hutchinson pickup was estimated at $5,000 while the utility pole received an estimated $500 in damage.

• On May 17, a car driven by a 17-year-old male from Marshalltown was southbound on South Center Street when it proceeded through the intersection on a red light colliding with a car driven by Ricky Neil Swanson, of Marshalltown, which had moved forward on the green light. No injuries were reported. The juvenile was cited for failure to obey a traffic control device. Damage to both vehicles was estimated at $1,000 each.

• On May 12, a bus driven by John Robert Page, of Marshalltown, was westbound on West Main Street and failed to stop at the intersection with 13th Street colliding with the rear of a pickup driven by Shane Edward Ecklor, of Marshalltown, sending it into the rear of a car driven by Shelbie Dea Garcia, of Marshalltown. No injuries were reported. Page was cited for failure to maintain control and reckless driving. Damage to the Page bus and Ecklor pickup were estimated at $1,000 each while the Garcia car received an estimated $500 in damage.

• On Wednesday, Seger Brown was arrested for failure to affix a drug tax stamp and conspire to manufacture/deliver methamphetamine.

• On Wednesday, Ryan Stubbs was arrested on a warrant.

• On Tuesday, Colton Lagerquist was arrested for possession of drug paraphernalia.

• On Tuesday, Dustin Veld was arrested for harassment-second degree.

Accidents

• On Sunday, a vehicle driven by Stephanie Lexis Littlepage, of Eldora, was southbound on Marsh Avenue when the driver noticed a spider on her steering wheel, reached for a tissue to kill it with, drove onto a narrow shoulder and ended up in a water filled ditch with her airbags deployed. No injuries were reported. Damage to the Littlepage vehicle was estimated at $5,000.

• On May 17, a semi driven by Lonnie James Crafton, of Maquoketa, was eastbound on Highway 30 when a gust of wind from a severe thunderstorm caused the vehicle to blow over and enter the median coming to rest on its left side. Crafton received minor injuries. Damage to the Crafton semi was estimated at $35,000.

• On May 9, a car driven by Jammar Dazmond Watkins, of Marshalltown, was southbound in the outside lane of Highway 14 when a dark colored SUV in the inside lane collided with the left rear corner resulting in the car entering the west ditch and the Suv leaving the scene. Watkins and three passengers were all transported to UnityPoint Health-Marshalltown. Damage to the Watkins car was estimated at $1,500. The incident was reported 11 days after the actual accident.

• On May 8, a car driven by Taylor Nicole Norton, of Le Grand, was northbound on Underwood Avenue when it went out of control on the loose gravel, was overcorrected resulting it the car entering the east ditch overturning as it went down the embankment and coming to rest on its top in a field. No injuries were reported. Damage to the Norton car was estimated at $3,000.

• On Wednesday, Tracy Lynn Lemay was arrested on a warrant.

• On Wednesday, Cecilia Ann Howe was arrested on a warrant.

• On Tuesday, Justin Dale Sutton was arrested on a warrant.
