Just as the the jury was deliberating in the wrongful death trial Thursday, lawyers on both sides reached a settlement and avoided a jury verdict.
The City of Marshalltown was defending itself against a lawsuit that claims it created conditions on Feb. 3, 2008 that led to the death of Debra Marie Mundt. The settlement brought an end to the trial that began Tuesday.
"I think it was a good arrangement all around," Gail Boliver, attorney for the Mundt family, said of the settlement.
Boliver said he could not give specific dollar figures on the settlement and directed that question to Mark Thomas, an attorney from Des Moines who represented the city. Thomas was unavailable when contacted at his office Friday afternoon.
City Administrator Dick Hierstein did not want to comment on the settlement when contacted Friday.
According to reports from the time of the accident, Mundt, 47, of Clutier, was driving northbound in the eastern-most lane of the Third Avenue viaduct when her vehicle slid across three other lanes, struck the western guardrail and went over the top of it. The vehicle came to rest on its roof after falling 25 feet. She was pronounced dead at the scene.
