Marshalltown man flees police on ATV
Police arrested a local man Friday after warning him not to drive an ATV on the street.
Derick Bear, 18, is charged with evading police after an officer allegedly spotted him driving an ATV on the 500 block of North Third Street Friday evening, said Marshalltown Police Chief Mike Tupper.
The officer warned Bear that driving an ATV on the street is illegal and told him to stop, Tupper said. A short while later, the officer again spotted Bear riding the ATV on the street and tried to pull him over.
Bear allegedly sped off, driving more than twice the posted 25 mph speed limit, according to reports released Wednesday.
Evading police is an aggravated misdemeanor.

Robert Dalton, address unknown, made an initial appearance on a driving under suspension charge. He pleaded not guilty and a pre-trial conference is set for 9 a.m. on Oct. 9 in Magistrate Court. He will represent himself in this case. Dalton was released on his own recognizance.
Derick Bear, 312 N. 8th Ave., made an initial appearance on a eluding charge, a driving under suspension charge, a no insurance charge, a careless driving charge and a speeding charge. He will represent himself in these charges before the court. The preliminary hearing is set for 1 p.m. on Sept. 24. Bond will continue as posted. The court ordered that Bear go to the Marshalltown Police Department to be fingerprinted and photographed before the close of business Wednesday.
Thomas Vandyke, 803 E. State St., made an initial appearance on a harassment/first degree charge and a criminal mischief/fifth degree charge. The public defender's office was appointed to handle his cases. The preliminary hearing is set for 1 p.m. on Sept. 24. Bond will continue as posted. The court ordered that if Vandyke possesses any firearms that he make arrangements with the Marshall County Sheriff to turn them in. A no-contact order was issued for the protected party.
Timothy Wendel, address unknown, made an initial appearance on a failure to appear charge. The public defender's office which was previously appointed will continue to represent. The pre-trial conference was reset for 1:30 p.m. on Sept. 7 and the trial date was rescheduled for 9 a.m. on Sept. 13.

On Sunday, a car driven by Donna Jean Hixson, 1116 May St., was turning from South 12th Avenue west onto East Anson Street and a vehicle driven by Frederick J. Stewart, 210 W. South St., was stopped facing east at the intersection of East Anson Street and South 12th Avenue and the two collided. No injuries were reported. Damage to the Hixson car was estimated at $3,000 while the Stewart vehicle received an estimated $600 in damage.
On Friday, a pickup driven by Michael John Hastings, of Des Moines, was northbound on the Frontage Road near Center Street and stopped at the intersection with Merle Hibbs Boulevard. When it proceeded forward it collided with the back half of a minivan driven by Conan Ray Schwartz, 403 Terry Terrace, which was traveling west on Merle Hibbs and had gone through the intersection of the Frontage Road and Merle Hibbs. No injuries were reported. Hastings was cited for failure to obey a stop sign and yield right of way. Damage to the Hastings pickup was estimated at $500 while the Schwartz minivan received an estimated $2,000 in damage.
On Aug. 30, a car driven by William Wesley Overman, of Rhodes, was southbound on South Seventh Avenue and stopped at the intersection with East Boone Street. He proceeded to go through the intersection into the path of a motorcycle driven by Michael Wayne Wilson, 610 Marion St., which collided into the side of the Overman car. Wilson was transported to Marshalltown Medical & Surgical Center with non-incapacitating injuries. Overman was cited for unsafe start of a stopped vehicle. Damage to the Overman car was estimated at $2,000 while the Wilson motorcycle received an estimated $2,500 in damage.
On Aug. 28, a car driven by Darwin Ramirez, of Ankeny, was westbound on East Olive Street at the intersection with South Third Avenue when it collided with the rear of a vehicle driven by David Todd Alexander, 413 E. Southridge Rd., which was stopped at the stop sign and left the scene of the accident. No injuries were reported. Ramirez was cited for leaving the scene of an accident, failure to have a valid driver's license and failure to stop within the assured clear distance. Ramirez failed to appear at the Police Department at the appointed time and an arrest warrant was issued. Damage to the Alexander vehicle was estimated at $100 while the Ramirez car received an estimated $2,500 in damage.
