Gladbrook woman hit with seven misdemeanor charges

Police arrested a Gladbrook woman Sunday evening after she allegedly stole from Hy-Vee then fled police.

Rochelle Smitherman, 52, allegedly stuffed a pork roast, two magazines and a doughnut into her purse at Hy-Vee before getting in her car and driving off, according to police reports.

When police attempted to pull Smitherman over, she allegedly kept driving for six blocks before pulling over on the 200 block of South Center Street.

A search of Smitherman's car allegedly revealed her to have four meth pipes, less than a gram of methamphetamine in her center console, 23 Alprazolam pills - a muscle relaxer - and four other prescription medications in a single bottle.

Police charged Smitherman with possession of drug paraphernalia, fifth-degree theft and driving under suspension, all simple misdemeanors, eluding, possession of meth, possession of schedule three drug - the Alprazolam - and unlawful possession of prescription medication, all serious misdemeanors.

Maria Isabel Andrade, of Waterloo, made an initial appearance on a driving while revoked charge, a operation while intoxicated-second offense charge and a child endangerment charge. The public defender's office was appointed to handle her cases. The preliminary hearing is set for 1 p.m. on Nov. 30. Bond is set at $2,000 cash or surety. Upon release, the court ordered that she obtain a substance abuse evaluation and submit the results to the court within 60 days of release.

Jason Hamilton, 201 N. 2nd Ave., made an initial appearance on a obstruction of emergency communication charge. He pleaded not guilty and a pre-trial conference is set for 9 a.m. on Dec. 18 in Magistrate Court. Hamilton was released on his own recognizance.

Randi Lea Mendyke AKA Holman, 408 1/2 N. 3rd St., made an initial appearance on a public intoxication charge. She pleaded guilty and was fined $65 with a $22.75 surcharge and $60 in court costs for a total of $147.75, due immediately. The court allowed for monthly installment payments of $50 beginning Dec. 17 until the debt is paid or in lieu of the fine and surcharge she may do 12 hours of community service plus pay the court costs to be completed by March 15, 2013.

Mariah Suzanne Tufte, 310 S. 4th St., made an initial appearance on a interference with official acts charge and a violation of a no-contact order charge. On the interference with official acts charge she pleaded guilty and was fined $250 with a $87.50 surcharge and $60 in court costs for a total of $397.50, due immediately. The court allowed for monthly installment payments of $50 beginning Dec. 17 until the debt is paid or in lieu of the fine and surcharge she may do 46 hours of community service plus pay court costs to be completed by March 15, 2013. On the violation of no-contact order the court continued the appointment of Randy Giannetto to represent Tufte in this case. The contempt hearing is set for 3:30 p.m. on Dec. 5. Bond in this case is set at $1,000 cash or surety.

Leodean Peters, of Montour, made an initial appearance on a speeding charge. He pleaded not guilty and a pre-trial conference is set for 9 a.m. on Jan. 8. in Magistrate Court.

Lewis Fonseca Garcia, 1704 Edgebrook Dr. Apt. #1, made an initial appearance on a warrant that was issued for failure to appear for a sentencing hearing. Marshon Dubbert will continue to represent Fonseca Garcia in this matter. A scheduling hearing is set for 9 a.m on Nov. 26. Bond will continue as posted.

Erica Velez, 204 N. 7th Ave., made an initial appearance on a theft-third degree charge. The public defender's office was appointed to handle her case. The preliminary hearing is set for 1 p.m. on Dec. 10. Velez was released through the Department of Correctional Services and is to contact them within 24 hours.

Donald Leroy Schmidt, 1101 Washington St., made an initial appearance on a harassment-first degree charge. The public defender's office was appointed to handle his case. The preliminary hearing is set for 1 p.m. on Nov. 27. Bond is set at $2,000 cash or surety. The court ordered that he be photographed and fingerprinted on this charge. A no-contact order was issued for the protected party.

The preliminary hearing is set for 1 p.m. on Dec. 10. Leitz was released through the Department of Correctional Services and is to contact them within 24 hours. A no-contact order was issued for the protected party.

Dolphus Coleman, of Marshalltown, made an initial appearance on a harassment-third degree charge. He pleaded not guilty and a pre-trial conference is set for 9 a.m. on Jan. 8, 2013, in Magistrate Court. A no-contact order was issued for the protected party.

Johnny Alan Minteer, of Steamboat Rock, made an initial appearance on an interference with official acts charge. The public defender's office was appointed to handle his case. The preliminary hearing is set for 1 p.m. on Nov. 27. Bond is set at $1,000 cash only. Upon release, the court ordered that Minteer be released through the Department of Correctional Services.

Krystal Diana Diver, of Liscomb, made an initial appearance on a possession of contraband in a correctional facility charge and a possession of a controlled substance charge. The public defender's office was appointed to represent her in these cases. The preliminary hearing is set for 1 p.m. on Dec. 10. Diver was released through the Department of Correctional Services and is to contact them within 24 hours.

Melissa Anne Bisson AKA Molli Kay Bisson, 1108 Iowa Ave. #14, made an initial appearance on a probation violation on a domestic abuse charge and a probation violation on a theft-third degree charge. The public defender's office was appointed in both cases. In the probation violation regarding the domestic abuse charge a scheduling hearing is set for 1 p.m. on Nov. 20. The probation revocation hearing was then set for 11 a.m. on Dec. 12. Bond is set at $2,000 cash bond. On the probation violation for the theft-third degree charge a scheduling hearing was also set for 1 p.m. on Nov. 20. A pre-trial conference is set for 1:30 p.m. on Feb. 8, 2013 and a trial is set for 9 a.m. on Feb. 14, 2013. Bond in this case is also set at $2,000 cash only.

Grundy County Sheriff's Office

Arrests

On Sunday, Jeremy Smith, age 40, of Wisconsin Dells, Wis., was arrested in Grundy Center and charged with possession of a controlled substance. He posted bond and was released.

On Sunday, Richard Sampson, age 49, of Hastings, Mich., was arrested in Grundy Center and charged with possession of a controlled substance. He posted bond and was released.

On Saturday, Bryan Leadley, age 26, of Waterloo, was arrested for domestic abuse assault. He was released on promise to appear.

On Nov. 13, Jonathan Owens, age 48, Des Moines, was arrested by Polk County authorities on a Grundy County warrant charging him with theft-second degree and forgery. He posted bond and was released.

Accidents

On Saturday, a car driven by Patrick Brown, age 37, of Grundy Center, was southbound on Highway 14 when it struck a deer that entered the roadway. No injuries were reported. Damage to the Brown car was estimated at $2,000.

On Thursday, a vehicle driven by Tammy Strait, age 54, of Whitten, was westbound on 310th Street east of F Avenue when it struck a deer that entered the roadway. No injuries were reported. Damage to the Strait vehicle was estimated at $2,500.

On Nov. 14, a car driven by Jonathan Hindman, age 18, of Marshalltown, was westbound on D-67 at the intersection with Highway 14 when it pulled out to turn south onto Highway 14 and collided with a vehicle driven by James King, age 20, of Lawler, which was traveling north on Highway 14. No injuries were reported. Hindman was cited for failure to yield upon entering a through highway. Damage to the Hindman car was estimated at $5,000 while the King vehicle received an estimated $3,000 in damage.
