Court — Wednesday

• William D. Fricke made an initial appearance on a operating while intoxicated-second offense charge and a driving while revoked charge. The public defender’s office is appointed as counsel. The preliminary hearing is scheduled at 1 p.m. on Feb. 12. Fricke is released on his promise to appear. A substance abuse evaluation is ordered with the results submitted to the court within 60 days.

• Adrian Lavon Kincade made an initial appearance on an assault causing bodily injury or mental illness charge. The public defender’s office is appointed as counsel. The preliminary hearing is scheduled for 1 p.m. on Feb. 12. Kincade was released on his promise to appear. A no-contact order has been issued for the protected party.

• Justin Scott Zitzow made an initial appearance on a failure to appear for a trial charge and for two new charges of unauthorized use of a credit card charge and an identity theft charge. The public defender’s office is assigned for all cases. A pre-trial conference is scheduled at 1:30p.m. on Feb. 8. A preliminary hearing on the new charges is scheduled at 1 p.m. on Feb. 12. Zitzow is released with supervision through the Department of Correctional Services and is to report to the adult probation office by the end of work on Jan. 25 to sign a pre-trial release agreement.

• Amanda Jo Moore made an initial appearance through counsel, Katherine Sears, on an operating while intoxicated-first offense charge and a failure to maintain control charge. The preliminary hearing is waived. Bond is set at $1,000 cash or surety. A substance abuse evaluation is ordered with the results submitted to the court within 60 days.

• Deano Puccio made an initial appearance on a driving under suspension charge and a no insurance charge. Puccio pleaded not guilty and a pre-trial conference is scheduled at 9:30 a.m. on March 6 in Magistrate Court.

• Jose Morales Garcia made an initial appearance on a driving under suspension charge. Morales Garcia pleaded not guilty and a pre-trial conference is scheduled at 9:30 a.m. on Feb. 20 in Magistrate Court.

• Jose Cruz made an initial appearance on a possession of drug paraphernalia Carthage. Cruz pleaded guilty and the fine is $65 with a $22.75 surcharge, a $125 law enforcement initiative surcharge, a $10 DARE surcharge and $60 in court costs for a total of $282.75, due within 30 days.

• Miguel Angel Gutierrez made an initial appearance on a driving under suspension charge and a speeding charge. Gutierrez pleaded not guilty and a pre-trial conference is scheduled at 9:30 a.m. on Feb. 20 in Magistrate Court.

Arrests

• On Jan. 22, Justin Zitzow, 22, was arrested for identity theft, unauthorized use of a credit card and on a warrant.

• On Jan. 22, Adrian Kincade, 41, was arrested for assault causing bodily injury.

Accidents

• On Jan. 20, a car driven by Cheryl G. Holmes, 66, of Clanton, Ala., was southbound on Third Street when it went through a stop sign and collided with a vehicle driven by Ivan Garcia Torres, 19, of Marshalltown, resulting in Holmes airbag deploying obstructing her view and Holmes car colliding with a car driven by Jesus Alonzo Corona, 20, of Marshalltown, which was sitting at a stop sign facing north on Third Street. No injuries were reported. Holmes was cited for failure to obey a stop sign and yield the right of way. Damage to the Alonzo Corona and Garcia Torres vehicles was estimated at $500 each while the Holmes car received an estimated $3,000 in damage.

• On Jan. 22, William Fricke, 58, was arrested for driving while license is revoked and operating while under the influence-second offense.

• On Jan. 22, Delilah Elaine Mauskemo, 33, was arrested on a warrant.
