Assault victim dies from his injuries

Suspect remains in jail; new charges pending

A Marshall County man has died from injuries suffered during a fight Monday in the 200 block of West Church Street in Marshalltown.

On Wednesday, a Marshalltown Police Department press release reported the death of David Wayne Lurvey, 55.

The MPD said they were informed by the Polk County Medical Examiner’s Office of Lurvey’s death on Tuesday. An autopsy was performed Wednesday at 8 a.m. Results are pending.

At approximately 5:46 p.m., Monday, police responded to the area after receiving reports of a fight. Upon arrival, officers located Lurvey, who was critically injured during the altercation.

Lurvey was subsequently taken to a medical facility in Marshalltown and later taken by air transportation to a Des Moines medical facility.

Wyatt Kane Slinker, 23, of Marshalltown was initially charged with assault causing serious injury after an investigation.

Slinker alleged Lurvey attempted to punch Slinker’s wife when he intervened, according to Marshall County District Court records.

“All we know is that there was an altercation,” said MPD Chief Mike Tupper.

Tupper said the case remains under investigation and has been forwarded to the Marshall County Attorney’s Office for additional charges.

Slinker is currently being held in the Marshall County Jail on a $5,000 cash or surety bond.
