Man found guilty of stabbing father during 2017 altercation faces prison term

A State Center man will be sentenced at 1:30 p.m. on Jan. 14 in Marshall County District Court after a jury found him guilty last month of multiple offenses stemming from a 2017 altercation where he stabbed his father several times.

Brian Wayne Wengert, 45, faces a mandatory prison term on the most serious of the charges — willful injury causing serious injury.

Assistant Marshall County Attorney Sarah Tupper, who prosecuted the case, said the charge is a forcible felony, and Iowa law requires the judge issue a prison sentence.

The maximum sentence is 10 years.

“And the jury answered a special interrogatory and found he was armed with a dangerous weapon while he committed that crime,” she said. “That is a special sentencing enhancement that applies to half of the sentencing on that count.”

The jury also found Wengert guilty on counts of:

• Assault with intent to to inflict serious injury.

• Domestic abuse assault while using or displaying a dangerous weapon.

• Possession of a controlled substance.

Tupper said the judge has discretion of sentencing prison or probation on those counts. The judge also has discretion of running the sentencing concurrently or consecutively.

Wengert was taken into custody on Oct. 21, 2017, after he allegedly stabbed his father multiple times during an altercation at a State Center residence.

The Marshall County Sheriff’s office was initially alerted of a special medical situation at the address.

When a sheriff’s deputy arrived, authorities found Randy Wengert, then 70, laying in the front yard of the residence, suffering from “obvious trauma.”

The man was transported by ambulance to UnityPoint Health – Marshalltown, and later moved to a trauma unit at a Des Moines hospital.

After initially tending to the the elder Wengert, the deputy then entered the residence and found Wengert’s son, Brian Wengert, then 44, who was subsequently identified as a person of interest in the incident.

Marshall County Sheriff Steve Hoffman told the Times-Republican Brian Wengert lived at the residence with his father and mother. His mother was inside the residence during the time of the altercation, but was not injured.

Authorities transported the younger Wengert to the Marshalltown hospital for observation initially, but not due to any apparent injury, Hoffman said. Medical officials later released Brian Wengert to the sheriff’s office and deputies took him to the Marshall County Jail, where he remained in custody.

Following an interview with the suspect, the sheriff’s office charged Brian Wengert with attempted murder.

The sentencing will take place in a courtroom at the Max Building, 101 S. First Ave., since the Marshall County Courthouse is closed to the public for repairs following the July 19 tornado.
