Local woman’s license revoked after tragic accident

A Marshalltown woman who pleaded guilty for failing to yield to a pedestrian in a crosswalk which resulted in the death of a eight-year boy was sentenced last week to one year of suspended probation according to court records.

Additionally, her drivers’ license was revoked for 180 days.

Marilyn Kay Diggins, 71, struck Franklin Elementary School second grader Christian Paul Maxon with her pickup truck in the crosswalk May 15.

“The child was crossing Main Street when he was struck by Diggins’ truck turning east onto Main Street from the 10 block of South 13th Street,” the police statement read.

“The 8-year-old was on his way home from school when the crash occurred, “according to witness statements.

Maxon was discovered at the scene by his father, Timothy Maxon, 35.

He was taken to UnityPoint Health-Marshalltown before being flown by air ambulance to Blank Children’s Medical Hospital in Des Moines, where he was pronounced dead.

“All agreed this tragedy was an accident and unintentional,” Magistrate Judge Barry Kaplan said. “Defendant is quite remorseful for obvious reasons.”

Funeral Services for Maxon, 8, were held on May 20 at Marshalltown’s New Hope Christian Church

He was laid to rest in Riverside Cemetery.
