Drug charges for local pair

Police arrested two men with possession of marijuana charges Saturday.

Capt. Mike Hanken, with the Marshalltown Police Department, said Hector Lizarde-Garcia, 20, and Gustavo Diaz, 20, both of Marshalltown, were driving on the 700 block of South Center Street Saturday when an MPD officer attempted to pull them over for driving without a license plate.

Lizarde-Garcia allegedly failed to pull over and began throwing marijuana out the window while driving. When he finally stopped on the 200 block of South Seventh Avenue, the officer arrested the men.

Police charged Lizarde-Garcia with driving under suspension and no insurance, both simple misdemeanors, eluding and possession of one gram of marijuana, both serious misdemeanors, and possession of four grams of marijuana, an aggravated misdemeanor.

They charged Diaz with possession of one gram of marijuana.

A juvenile male from Marshalltown made an initial appearance on a curfew violation charge. He pleaded guilty and was fined $65 with a $22.75 surcharge and $60 in court costs for a total of $147.75, due immediately. The court allowed for 12 hours of community service in lieu of the fine and surcharge plus pay the court costs of $60 to be completed by Jan. 31, 2013. Furthermore the judge ordered Harding to secure a copy of the curfew ordinance by the end of work today.

A male juvenile from Marshalltown made an initial appearance on a curfew violation charge. He pleaded not guilty and a pre-trial conference is set for 9 a.m. on Jan. 15, 2013.

A juvenile male from Haverhill made an initial appearance on a reckless driving charge. He pleaded guilty and was fined $65 with a $22.75 surcharge and $60 in court costs for a total of $147.75, due immediately. In lieu of the fine and surcharge he may complete 12 hours of community service plus pay court costs of $60 to be completed by Jan. 31, 2013.

Brent Jon Specht, address unknown, made an initial appearance on a operating while intoxicated-second offense charge and a driving under suspension-unpaid fines charge. The public defender's office was appointed to handle his cases. The preliminary hearing is set for 1 p.m. on Dec. 21. Specht was released on his own recognizance. The court ordered that he obtain a substance abuse evaluation and submit the results to the court within 60 days.

Scott Mills Jr., address unknown, made an initial appearance on a theft-fourth degree charge. The preliminary hearing is set for 1 p.m. on Dec. 21. Mills was released on his own recognizance.

Dolphus Coleman, Homeless, made an initial appearance on a harassment-first degree charge. The public defender's office was appointed to handle his case. The preliminary hearing is set for 1 p.m. on Dec. 13. Bond is set at $2,000 cash or surety. A no-contact order was issued for the protected party. The court ordered that if Coleman possessed any firearms or ammunition he is to contact the Marshall County Sheriff's Office and make arrangements to surrender them within 24 hours.

Kimberly Scarborough, of State Center, made an initial appearance on a driving while license is denied, cancelled, revoked or suspended charge, a operation without registration charge and a failure to obey a stop or yield sign charge. She pleaded guilty to all three charges. On the driving while license is denied, cancelled, revoked or suspended charge the fine was $250 with a $87.50 surcharge and $60 in court costs for a total of $397.50, due immediately. The fine on the operation without registration charge was $50 with a $17.50 surcharge and $60 in court costs for a total of $127.50, due immediately. On the failure to obey a stop or yield sign the fine was $100 with a $35 surcharge and $60 in court costs for a total of $195, due immediately.

Audel Ruiz-Zavala, 307 N. 4th Ave., made an initial appearance on a failure to stop within a safe and sure distance charge. He pleaded not guilty and a pre-trial conference is set for 9 a.m. on Jan. 15, 2013.

Stephanie Martelli, 134 E. Main St. Apt. #806, made an initial appearance on a theft-fifth degree charge. She pleaded guilty and was fined $65 with a $22.75 surcharge and $60 in court costs for a total of $147.75 plus restitution of $114 if applicable, due immediately.

Logan Kelly, of Albion, made an initial appearance on a underage possession of alcohol charge. He pleaded guilty and was fined $200 with a $70 surcharge and $60 in court costs for a total of $330 due immediately.

On Sunday, Ricky Dean Heiter, 1703 Edgebrook Dr. Apt. G3, reported damage to the windshield on a Chevy S10 pickup from a pumpkin thrown at the windshield while parked at his residence. Estimated value of damage was $200.

On Saturday, Joseph Daniel Criado, 112 N. 3rd St. Apt. #4, reported the theft of a DK bicycle from 105 W. Boone St. Estimated value of loss was $180.

On Friday, Taro Louis Banes, 1807 Summit St., reported hit and run damage to the left outside mirror and left rear quarter panel on a 1999 Ford Contour while parked at his residence. Estimated value of damage was $1,100.

On Thursday, Donnie Louis Benda, 205 N. Helm St., reported the theft of cash in the amount of $224 from his residence.

On Thursday, Kyla Carol Bachman, 1714 W. Lincolnway, reported damage to a windshield on a 2000 Olds Alero while parked at 917 N. 4th Ave. Estimated value of damage was $300.
