A male victim was struck numerous times in the face and ribs by a local man at the Marshalltown Burger King Sunday, resulting in the aggressor's arrest and incarceration.
Sean Matthews Smith, 35, of Marshalltown was taken into custody by local police on a charge of assault causing bodily injury, according to a criminal complaint and affidavit filed in Marshall County District Court. The victim had red marks by both eyes, a small cut on his lip and a red mark on his rib cage, according to the complaint. The defendant fled the scene before officers arrived. Consequently, a warrant was issued for his arrest. Smith was later apprehended.
At his initial appearance Wednesday, a magistrate issued a no contact order against Smith, meaning he can not contact the victim. The magistrate also ordered Smith be held on $1,000 bond cash or surety. His preliminary hearing is March 8.
