City settles with former Finance Director

Former City of Marshalltown Finance Director Lori Stansberry will be awarded a total of $85,000 as part of agreement reached between her and the city.

For the entire “Resignation of Employment and Approving Release” agreement to be binding, it required city council ratification, which was done April 27.

Critical to the agreement is Stansberry’s worker’s compensation claim, set forth in Case No. 5050062, must be approved by the respective parties including the Workmen’s Compensation Commissioner.

Key components of the agreement were:

– It called for Stansberry to resign effective April 30, and the city accepted her resignation.

– Stansberry will not seek reemployment with the city in the future.

– On or about the first full week in July 2015, a lump sum payment of $42,500 would be paid to her attributable to her workers’ compensation claim.

– On or about the first full week of May 2014, a lump sum payment of $40,000 would be paid to Stansberry attributable to her workers’ compensation claim.

– On or about the first week in May 2015, a lump sum severance payment of $2,500, less all applicable payroll taxes and any other legally required deductions.

– The city did not contest Stansberry’s application for unemployment benefits after the conclusion of the severance period.

– Stansberry agrees not to sue or institute or cause to be instituted any kind of claim or action in any federal, state, or local agency or court against the city arising out of her employment.

– The city agrees to only provide the following information if contacted by a prospective employer of Stansberry: 1) the dates of her employment and she resigned April 30, 2015. 2) Her salary history; and 3) the jobs she held while a city employee. She will direct all reference inquiries to City Personnel Director Jill Petermeier to ensure compliance.

– Effective May 1, 2015, Stansberry will be eligible for COBRA health insurance at her own expense pursuant to the city’s personnel policies.

The agreement was signed by Mayor Jim Lowrance April 28.

Her replacement, Brian DeMoss, was confirmed as city treasurer at the April 27 meeting.

The agreement was given to the Times-Republican by City Administrator Wetmore and Petermeier after council approval.

Wetmore and Petermeier declined to comment on the agreement, saying it was a personal matter.

Stansberry did not return a telephone call seeking a comment.
