Driver in accident killing 8-year-old charged

The driver in the car accident which killed a Franklin student last week has been charged with failure to yield to right of way of pedestrian, according to Marshalltown Police.

Marilyn Diggins, 71, hit 8-year-old Christian Maxon last week when he was walking home from school. He later died of his injuries.

The accident occurred at the intersection of 13th Street and Main Street just after school got out. Police spent a little more than a week investigating before charges were filed. In a release, they said the investigation is still ongoing.

The charge requires a court appearance, according to a police press release. Diggins has been released to appear in Marshall County Court on May 31.
