Woman involved in fatal car accident pleads not guilty

The woman involved in a car accident leading to the death of an 8-year-old elementary student pleaded not guilty to a failure to yield charge on Friday.

Marilyn Diggins, 71, was charged last week with failure to yield to right of way of pedestrian. Diggins hit Franklin Elementary Christian Maxon with her vehicle shortly after school got out on May 15 as he was walking home from school. He died later that night from injuries. Police spent a little more than a week investigating before announcing the charge.

Diggins did not appear in Marshall County District Court, but had attorney Doug Beals file an appearance on her behalf. A pre-trial conference is set for 9:30 a.m. on July 10.

If found guilty, Diggins would face a scheduled fine of $100 in addition to standard court fees.
