Eldora man charged with two felony counts of sex abuse

Cesar Leonel Garcia, 36. Eldora, was arrested by Marshalltown police at the Hardin County Jail and taken to Marshall County Jail on a warrant charging him with two criminal counts of sexual abuse-second degree according to court documents.
The warrant was issued as a result of an investigation by the MPD that demonstrated Garcia participated in two separate sex acts with the same 11-year victim at a Marshalltown residence in December 2017 and February 2018.
Both instances occurred when Garcia was 34.
Garcia was being held in Hardin County Jail by the United States Department of Homeland Security’s Immigration and Customs Enforcement officials on federal immigration charges according to court documents.
ICE turned over custody of Garcia to Marshall County authorities once a petition for writ of habeas corpus was submitted by assistant Marshall County attorney Kiyoko Kiefer.
On Tuesday, a magistrate appointed Garcia a public defender, ordered a no contact order against Garcia to protect the victim, and was ordered held in jail on $200,000 cash-only bond.
His preliminary hearing is Nov. 1.
