On Tuesday night at 9:45 p.m, the Marshalltown Police Department arrested Miguel Angel Gutierrez, age 28, of Marshalltown and charged him with sexual abuse in the third degree. Gutierrez was taken to the Marshall County Jail and remains in their custody.

The arrest was made in connection with an investigation that began on April 10, 2023 involving a crime reported by an adult female. A criminal complaint indicated that Gutierrez encountered the alleged victim at a Marshalltown bar on April 2 and took her back to her apartment and performed a sex act on her after she had become heavily intoxicated and was therefore unable to consent. The report also said that Gutierrez initially denied performing a sex act when asked by both the alleged victim, who did not recall it but believed “something had happened to her body,” and investigators, but subsequently admitted it a day later.

Bond has been set at $10,000 cash, and a preliminary hearing is set for Oct. 13 at 9:30 a.m. Anyone with information about the incident is asked to contact the Marshalltown Police Department at 641.754.5729.
