Marshalltown woman reaches plea deal, agrees to pay restitution to local nonprofits

A Marshalltown woman who was arrested earlier this year for allegedly stealing over $40,000 from a pair of local nonprofit organizations has reached a plea agreement that will result in a deferred judgment, probation and a requirement to pay restitution to both the Bobcat Booster Club and the Marshalltown Pride Afterprom Committee.
According to documents posted to Iowa Courts Online Tuesday, 45-year-old April McKibbin, her attorney Jennifer Weaver and Marshall County Attorney Jordan Gaffney have agreed to the deal, which stipulates that McKibbin will pay $12,000 in advance to the Bobcat Booster Club and $3,500 to the Afterprom Committee before subsequently pleading guilty to a single count of first degree theft, a Class C felony, with the state recommending a deferred judgment, a $1,370 suspended civil penalty, five years of supervised probation, submission of a DNA specimen, an assessment of victim restitution in full for both organizations ($35,594.28 less the $12,000 in restitution paid in advance for the Booster Club and $7,055.75 less the $3,500 in restitution paid in advance for the Afterprom Committee) and that the defendant must agree to be assessed all court costs and court appointed attorney fees.
The state will also dismiss the remaining criminal charges of second degree theft and identity theft over $1,500 under $10,000 against McKibbin. A pretrial conference regarding the case was held Tuesday, and a plea hearing date has not yet been set.
At presstime, Weaver, the Booster Club and the Afterprom Committee had not responded to requests for comment. Gaffney declined to issue an official statement but said the agreement had been reached after consultation with the victims.
