Almost all of the charges against one of the two Marshalltown men arrested on Sept. 6 in connection with a possible drive-by shooting on North 14th Avenue have been dropped, according to court records.
While 20-year-old Tyree Letrell Rudolph still faces a total of nine criminal charges -- eight of them felonies -- along with interference with official acts, Marshall County Attorney Jordan Gaffney filed a motion to drop all but one charge against 20-year-old Jeremiah McMullen on Thursday. McMullen, who has a previous felony conviction, is still charged with possession of a firearm by a prohibited person, but the remaining charges of two counts of attempted murder, both Class B felonies, one count of tampering with a witness and two counts of intimidation with a dangerous weapon -- injure/provoke fear, all Class C felonies, two counts of assault while participating in a felony and two counts of going armed with intent, all Class D felonies, and reckless use of a firearm -- property damage have all been dismissed.
Gaffney's motion to dismiss most of the charges against McMullen indicated that since his initial arrest, "additional investigation by law enforcement has led to the discovery of evidence that exonerates the Defendant as the perpetrator of this shooting."
When contacted by the T-R over the weekend, Gaffney declined to comment, citing the remaining pending charge against McMullen.
