CEDAR RAPIDS -- A lawsuit filed by former Tama County Human Resources Manager and Insurance Administrator Tammy Wise against the current Board of Supervisors alleging libel and violation of due process has been refiled and sent to federal court, according to publicly available documents.
After her original lawsuit in Tama County District Court was voluntarily dismissed without prejudice on Aug. 5, a revised complaint was filed two weeks later by Wise's attorney Michael Carroll, and on Sept. 21, the matter was reassigned to the Northern District of Iowa Federal Court based in Cedar Rapids.
The revised complaint covers much of the same territory as the previous lawsuit while adding comments about the fact that the allegations against Wise leading to her termination by the board were then passed along to the Iowa State Auditor's Office, resulting in a press conference held by State Auditor Rob Sand and the release of an audit noting over $250,000 in "questionable spending" that Wise says contains false statements about her job performance and alleged misconduct in her position.
The lawsuit seeks unspecified damages, and the county has denied wrongdoing. A trial date has not yet been set. At presstime, attorneys for both the plaintiff and the defendants had not responded to a request for comment.
