• Sims Holmes Matlock made an initial appearance on an operating while under the influence-second offense charge. Stephen Allison is appointed as council. The preliminary hearing is set for 9:30 a.m. on Jan. 30. A substance abuse evaluation is ordered with the results submitted to the court.

• Austin Lee Burke made an initial appearance on a theft-fifth degree charge and a possession or purchase of alcohol by person 18/19/20-first offense charge. Patrick Peters is appointed as counsel. The pre-trial conference is set for 9:30 a.m. on Feb. 5 in Magistrate Court.

• Donald Junior failed to appear for a possession of drug paraphernalia charge and the court found him guilty. The fine is $105 with a $15.75 surcharge and $60 in court costs for a total of $180.75.

• Jason Allen Smith made an initial appearance on a driving under suspension charge, a driving while barred charge and a no insurance charge. Mark Torche is appointed as counsel. The preliminary hearing is set for 9:30 a.m. on Jan. 30.

• Eulalia Jane Salazar made an initial appearance on a theft-third degree charge. Benjamin Feld is acting as counsel. The preliminary hearing is waived.

• On Thursday, Jan. 9, Sims Matlock, 49, was arrested for operating while under the influence-second offense.

Accidents

• On Tuesday, Dec. 17, a SUV driven by Trinity Alanna Waldman, 23, of Denver, Colo., was northbound on Highway 330 when it struck a deer that entered the roadway. No injuries were reported. Damage to the Waldman SUV was estimated at $5,000.

• On Saturday, Dec. 14, a SUV driven by Brent Joseph Riese, 29, of Marshalltown, was northbound on Highway 330 when it struck a deer in the roadway resulting in heavy front end damage. No injuries were reported. Damage to the Riese SUV was estimated at $10,000.

• On Saturday, Dec. 14, an SUV driven by Joel Charles Lewarne, 68, of Marshalltown, slammed on his brakes to avoid hitting a deer in the roadway. A car driven by a 16-year-old female, of Laurel, was following close behind and collided with the rear of the Lewarne SUV. No injuries were reported. The juvenile was cited for no insurance-accident and following too close. Damage to the Lewarne SUV was estimated at $2,000 while the car received an estimated $1,500 in damage.
